Аннотация: Актуальность темы исследования связана с тем, что в действующей системе наследственного права в России, которая регулируется частью 3 ГК РФ, а именно разделом V «Наследственное право» такие меры как ограничение, утрате и восстановление наследственных прав можно рассматривать как специальные правовые механизмы, имеющие единство и взаимную связь. Они выражают интерес и волю субъектов наследственного права при установлении соответствующих ограничений, а также по вопросам утраты и восстановления прав наследования. При этом, существуют и объективные основания для ограничения таких прав, и возможно со стороны государства мер сдерживания или прекращения таких прав, как и их восстановления. В любом случае, данные меры направлены на защиту наследственных прав. Ограничение, утрата и восстановление наследственных прав – это правовые механизмы, установленные законодательством. В первом случае, в связи с прекращением или приостановление прав, наличия обременений или запретов (на основе судебных решений или действий заинтересованных лиц через нотариуса). Во втором случае это механизм прекращения наследственных прав на основе судебных решений (либо, в отдельных случаях, через нотариуса по инициативе заинтересованных лиц), в том числе, и в качестве меры ответственности наследника. В третьем случае это механизм восстановления тех прав, которые были утрачены, также, в основном, на основании судебных решений. Надо сказать, что действующее российское гражданское законодательство в части регулирования вопросов наследования имеет ряд дефектов в части регулирования механизмов ограничения, утраты и восстановления наследственных прав. В связи с этим данные механизмы не всегда возможно эффективно применять по отношению к ряду субъектов, с учетом правового режима некоторых из них, а также с учетом разных сроков, в течение которых действуют наследственные права, форм и способов осуществления этих прав и т.п. Именно это объясняет необходимость совершенствования нормативно-правового регулирования механизмов ограничения, утраты и восстановления наследственных прав, включая основания, формы, способы реализации данных механизмов.

Abstract: The relevance of the research topic is due to the fact that in the current system of inheritance law in Russia, which is regulated by Part 3 of the Civil Code of the Russian Federation, namely, Section V "Inheritance Law", such measures as limitation, loss and restoration of inheritance rights can be considered as special legal mechanisms that have unity and interconnection. They express the interest and will of the subjects of inheritance law when establishing appropriate restrictions, as well as on the loss and restoration of inheritance rights. At the same time, there are objective grounds for limiting such rights, and possibly on the part of the state, measures to restrain or terminate such rights, as well as their restoration. In any case, these measures are aimed at protecting inheritance rights. Limitation, loss and restoration of inheritance rights are legal mechanisms established by law. In the first case, in connection with the termination or suspension of rights, the presence of encumbrances or prohibitions (based on court decisions or actions of interested parties through a notary). In the second case, it is a mechanism for the termination of inheritance rights on the basis of court decisions (or, in some cases, through a notary at the initiative of interested parties), including as a measure of responsibility of the heir. In the third case, this is a mechanism for restoring those rights that have been lost, also mainly on the basis of court decisions. It must be said that the current Russian civil legislation in terms of regulating inheritance issues has a number of defects in terms of regulating mechanisms for limiting, losing and restoring inheritance rights. In this regard, these mechanisms are not always possible to effectively apply in relation to a number of subjects, taking into account the legal regime of some of them, as well as taking into account different periods during which inheritance rights are valid, forms and methods of exercising these rights, etc. This is what explains the need to improve the legal regulation of mechanisms for limiting, losing and restoring inheritance rights, including the grounds, forms, ways of implementing these mechanisms.

Adnotacja: Trafność tematu artykułu wynika z faktu, że w obecnym systemie prawa spadkowego w Rosji, który reguluje część 3 kodeksu cywilnego Federacji Rosyjskiej, a mianowicie rozdział V „Prawo spadkowe”, takie środki jak przedawnienie, utratę i przywrócenie praw do dziedziczenia można uznać za szczególne mechanizmy prawne, które charakteryzują się jednością i wzajemnym połączeniem. Wyrażają zainteresowanie i wolę podmiotów prawa spadkowego w ustaleniu odpowiednich ograniczeń, a także utracie i przywróceniu praw spadkowych. Jednocześnie istnieją obiektywne podstawy do ograniczania tych praw, a być może ze strony państwa – do ograniczania lub wygaśnięcia tych praw, a także do ich przywrócenia. W każdym razie środki te mają na celu ochronę praw spadkowych. Przedawnienie, utrata i przywrócenie praw spadkowych to mechanizmy prawne ustanowione przez prawo. W pierwszym przypadku, w związku z wygaśnięciem lub zawieszeniem praw, występowaniem obciążeń lub zakazów (na podstawie orzeczeń sądowych lub działań zainteresowanych stron za pośrednictwem notariusza). W drugim przypadku jest to mechanizm wygaśnięcia praw spadkowych na podstawie orzeczeń sądowych (lub w niektórych przypadkach za pośrednictwem notariusza z inicjatywy zainteresowanych stron), w tym jako środek odpowiedzialności spadkobiercy. W trzecim przypadku jest to mechanizm przywracania utraconych praw, również głównie na podstawie orzeczeń sądowych. Trzeba powiedzieć, że obecne rosyjskie ustawodawstwo cywilne w zakresie uregulowania spraw spadkowych ma szereg wad w zakresie mechanizmów ograniczania, utraty i przywracania praw spadkowych. W tym zakresie mechanizmy te nie zawsze są możliwe do skutecznego zastosowania w odniesieniu do wielu podmiotów, biorąc pod uwagę reżim prawny niektórych z nich, a także biorąc pod uwagę różne okresy ważności praw spadkowych, formy i sposoby korzystania z tych praw itp. Stąd konieczność poprawy regulacji mechanizmów ograniczania, utraty i przywracania praw spadkowych, w tym podstaw, form, sposobów realizacji tych mechanizmów.

Literature review

The theoretical elaboration of the research topic is not particularly high. Indeed, since the current Civil Code of the Russian Federation does not contain separate chapters that would regulate the limitation, loss and restoration of inheritance rights, and these norms are disclosed in different chapters of Section V of the Civil Code of the Russian Federation, there are few and narrowly focused studies on these issues. If, in general, we consider the work on inheritance issues, where the issues of limitation, loss and restoration of inheritance rights are considered, we can mention such authors as A.B. Alieva [1], Yu.F. Bespalov [2], P.V. Krasheninnikov [3], E.Yu. Petrov [4]. It should be noted such an author as S.G. Lidzhieva [5], who devoted her own Ph.D. thesis (2017), as well as some other works, scientific articles to this issue. In general, there are very few scientific publications, articles on this research topic [6-9]. 


Materials and methods

The research methodology consists in the application of general scientific and private scientific research methods. Methods such as historical-legal and comparative-legal analysis, as well as complex analysis and synthesis, methods of comparison and modeling are used. For the study, we used foreign inheritance legislation (France, Austria), the norms of law of Russian legislation from the time of "Russian Truth" to the Soviet period. The current norms of Russian civil law and judicial practice were also used.


Research results

The author examined the norms of civil legislation of such countries of the continental system of rights as Austria and France. Austrian civil law contains a lot of rules that are related to the limitation and loss of inheritance rights. It should be noted that the well-established concept of inheritance is applied, the limits of limitation and loss of inheritance rights are clearly presented, there is a list of grounds associated with the loss of the right to a compulsory share, it is possible to draw up a will even by minors who have reached 14 years of age, but have not reached 18. Moreover, by law established and those provisions that limit the last will of the testator. The disadvantage is that the code does not contain clear rules for the possibility of restoring inheritance rights (with the exception of the possibility of forgiving an unworthy heir who is deprived of the right to a mandatory share). French civil law also contains a fairly detailed list of those unlawful acts (crimes) that would become the basis for recognizing the heir as unworthy. Also, sufficiently detailed restrictions have been established related to the granting of the right to a minor who has reached the age of 16 to draw up a will. The norms are also applied that restrict a number of persons to receive testamentary orders in their favor (medical and pharmaceutical workers who treated the deceased while treating a patient, judicial commissioners from clients, guardians from wards, the possibilities of obtaining such orders and social and medico-social organizations are limited). There is also a rule related to the payment of alimony benefits to a needy spouse by heirs. But there is no clear procedure for restoring inheritance rights, which is a drawback. In general, the analyzed French and Austrian inheritance legislation largely complies with the norms of Russian legislation, although there are deviations, since it provides for the drawing up of a will to minors, an oral will, the possibility of inheritance by children of heirs recognized as unworthy.


This was the development of the rules governing restrictions, loss and restoration of inheritance rights in pre-revolutionary Russia. At that time, each new legal act, from the Russian Pravda to the Code of Laws of the Russian Empire, regulated inheritance law in a more perfect form, including issues of limitation, loss and restoration of inheritance rights. In ancient Russian legal sources (“Russkaya Pravda”, Pskov letter of judgment) there were norms on the limitation and loss of inheritance rights, which concerned a number of subjects of such rights. In the Cathedral Code of 1649, and later in the Decree of Peter I "On the procedure of inheritance in movable and immovable property" dated March 23, 1714 (on single inheritance), provisions were included on the limitation and loss of such rights and on the object (mainly in connection with the inheritance of real estate). The Decree on single inheritance also contained rules for the restoration of inheritance rights. The Code of Laws of the Russian Empire - the first codified act of Russia - contained relevant sections devoted to the regulation of inheritance rights (inheritance by will and by law). And it included quite clear and clear rules for the limitation and loss of inheritance rights, provisions on the restoration of inheritance rights. They quite fully, in comparison with the previously applied legal acts, regulated legal relations in the field of inheritance.


The beginning of the Soviet period in the history of our country was characterized by the abolition of inheritance rights altogether, although not completely - property worth up to 10,000 rubles could be obtained at the disposal and management of children, spouses or parents, and the cost in addition was withdrawn in favor of the state, and a number of relatives in a straight line the descending or ascending line received content from this property. Similar norms, but already with the permission of the right of inheritance by law and by will, were provided for in the Civil Code of the RSFSR of 1922, when there was also a limit on the inherited amount of 10,000 gold rubles after deducting debts, and what, in addition, should have been withdrawn in favor of state. At the same time, the code established a rather narrow circle of heirs by law and rather strict terms for accepting the inheritance, which made it possible to seize inherited property in favor of the state as an escheat. Also, the 1922 code did not provide for the possibility of restoring inheritance rights. The Civil Code of the RSFSR in 1964 became a document that more fully regulates the issues of limitation, loss and restoration of inheritance rights. A circle of unworthy heirs was established, as well as rules were established on the mandatory share for minors and disabled heirs, regardless of the will. Also, this code establishes the rights of the testator to deprive the heirs of the inheritance, the right of the heir to refuse the inheritance, the possibility of restoring inheritance rights if the deadline is missed for valid reasons. Basically, these rules were included in the Fundamentals of Civil Legislation of the USSR and the republics of 1991. In the current Part III of the Civil Code of the Russian Federation, which entered into force in March 2002, Section V "Inheritance Law" also included the previously envisaged legal mechanisms of limitation, loss and restoration of inheritance rights, taking into account their addition, in order to eliminate the fragmented nature of legal regulation in this direction. At the same time, and until now, the Russian civil legislation does not contain definitions of the terms "restriction", "loss" and "restoration" of inheritance rights.


Restriction of inheritance rights, despite the absence of this term in the civil legislation of the Russian Federation, is measures that are aimed at ensuring the legal rights of the heirs, creditors of the testator, the state, and it consists in a temporary or permanent limitation on the acquisition of all or part of the inheritance. The limitation of inheritance rights is carried out in accordance with regulatory assets, at the will of the testator or heir, by decision of a notary or a court, in connection with the inaction of the heirs, provided for by international norms. Methods of limiting inheritance rights can be called prohibitions, obligations and imposing on the commission of actions, protective measures. At the same time, the limitation of inheritance rights may be associated with things that are limited in circulation, or cannot be inherited, with the specifics of determining the circle of heirs, including the identification of unworthy heirs, with the possible will of the testator to establish a legacy or assignment, with an inheritance contract, with a possible the rejection of the inheritance already by the heir (including, in favor of other heirs), which also has certain restrictions.


Loss of inheritance rights is a legal mechanism that is used more often by a court, less often by a notary. The measures included in this mechanism are associated with the termination of inheritance rights, more often - forcibly, but in some cases and voluntarily. Loss of inheritance rights is carried out upon deprivation of inheritance rights, their rejection, abandonment of them, in case of non-restoration of the terms of acceptance of the inheritance. The loss of inheritance leads to the termination of inheritance rights, either irrevocably, or with the possibility of restoration in the future (if there is the will of the heir who has lost the inheritance right). Restoration of inheritance rights is a legal mechanism associated with the return of lost inheritance rights, implemented through a court, and in an exceptional case (including, with the consent of the heirs) - through a notary, at the request of the interested party. The restoration of inheritance rights is closely related to their loss, including due to non-inclusion in a will, due to refusal under the influence of delusion, threats, deceit, due to inaction of legal representatives (in a child, in a disabled or disabled person), due to a pass terms for accepting the inheritance (for various reasons, including illness, etc.), due to court decisions or a notary's order, which may be unlawful and appealed in a higher court (recognition as an unworthy heir, non-allocation of a compulsory share, etc. .). In practice, the mechanism for restoring, first of all, the missed deadlines for accepting the inheritance is used quite often, in most cases these rights are restored, this is often done on the basis of judicial discretion. There is also a negative side, when inheritance rights are restored after a sufficiently long period, which creates legal uncertainty, violates the rights of not only the heirs who entered the inheritance at that time, but also third parties in transactions with them. But, in general, the limitation and loss of inheritance rights are measures of containment and termination, and restoration is a measure of the reverse acquisition of limited or even terminated rights in this area.


Inheritance of liability rights, intellectual rights have their own characteristics. It is important that in terms of rights of obligation, claims to debtors are inherited, except for those that are directly related to the person of the testator and are intended for him personally (including alimony, under a number of contracts, including agency, commission, gratuitous use) as well as payments awarded but not received. In terms of inheritance rights, inherited rights are exclusive rights to objects of intellectual activity (creative, scientific and inventive, some other types of activity), including the income received from them, taking into account the restrictions established by civil legislation (for example, a period of only up to 70 years after the death of the author or the last of the co-authors for the work, after which this right is forfeited), the right of access and following. But copyright and related rights themselves cannot be inherited, although the testator may impose obligations on the protection of the name and inviolability of the work. The law does not provide for the unclean property for the objects of intellectual rights. Of course, it is advisable for the acceptance of inheritance, including issues of limitation, loss and restoration of inheritance rights, to extend the general rules for the limitation, loss and restoration of inheritance rights. For example, loss can be foreseen if the heir contributed to the infringement of the rights of authorship, rights to the name and inviolability of the work during the period that is set for accepting the inheritance. Here it is advisable to apply the procedure for escheated property, when such rights would be transferred to the state.


Intangible benefits and non-property rights are indeed associated with the personality of each person, which is why Russian legislation indicates the impossibility of their inheritance, and most legal scholars agree with this. However, there are such moral rights, protected not only by civil, but also by constitutional law, by the norms of international law, and in part by criminal law. First of all, these are honor, dignity, good name, business reputation, the right to use the image and the right to privacy. According to the rules established by the Civil Code of the Russian Federation, after the death of a person, interested persons can defend his honor, dignity, good name, business reputation, although they are not directly indicated on the heirs. Moreover, the right to use the image and the right to use information related to the private life of a person can be given to third parties by persons delineated in inheritance law as heirs of the first priority by law, but in their absence, neither heirs of other queues nor heirs have this right. by will, which is an important omission. Therefore, appropriate changes are required in the norms of the Civil Code of the Russian Federation related to the inheritance of such non-property rights and non-material benefits.


Discussion

Based on the study, the following recommendations were made for amending the norms of the third part of the Civil Code of the Russian Federation, which is also considered by other authors.
1. To amend the norms of Article 1118 of the Civil Code of the Russian Federation, allowing the possibility of drawing up a will for children from 14 to 18 years old independently (regardless of emancipation), as well as for children under 14 years old and incapacitated, but their legal representatives and guardians under the control of the guardianship authority, which is used in the foreign experience considered in the work.
2. Supplement paragraph 2 of Article 1117 of the Civil Code of the Russian Federation to indicate the following: the basis for the loss of inheritance rights "when establishing the bad faith of the heirs, expressed in the absence of care for the testator during his lifetime, if the duty of such care is established by the Family Code of the Russian Federation." In article 1117.1 of the Civil Code of the Russian Federation, add: “Loss of inheritance rights entails the termination of their validity. Persons who have lost inheritance rights for valid reasons can be restored to such rights, in the manner and on the grounds established by the Civil Code of the Russian Federation. Persons whose rights are limited in the form of suspension of their action, exercise such rights in the event that the grounds for their suspension have ceased to exist ”.
3. To amend clause 1 of article 1155 of the Civil Code of the Russian Federation: to propose and improve legislation related to the restoration of inheritance rights, it should be possible only in a number of exceptional cases: with the consent of the interested parties, if a child, a person with limited or incompetent capacity, loses the right in the form his legal representatives, or due to diseases that really prevent the acceptance of the inheritance (coma, mental and physical disorders, etc.), to reduce the possibility of judicial discretion, to eliminate uncertainty and possible subsequent violation of the rights of heirs and third parties in connection with the restoration of terms ...
4. To supplement Chapter 65 of the Civil Code of the Russian Federation with Article 1185.1 "Acceptance of intellectual rights", that it is carried out according to the general rules established for the acceptance of inheritance, taking into account the provisions provided for by Part IV of the Civil Code of the Russian Federation and the mandatory registration of such rights.
5. Amend the norms of Article 1112 of the Civil Code of the Russian Federation, adding to it the possibility of inheritance of personal non-property rights and other non-material benefits, in respect of which the legislation of the Russian Federation, including international norms recognized by the Russian Federation, and international treaties of the Russian Federation allow for succession, as well as supplement Chapter 65 article 1185.2 "Acceptance of intangible benefits", indicating there that the acceptance of intangible benefits is carried out according to the general rules established for the acceptance of inheritance, taking into account the provisions of Chapter 8 of the Civil Code of the Russian Federation.


Conclusions and research prospects

I have developed measures to improve the current civil legislation to eliminate defects in law in the application of limitation, loss and restoration of inheritance rights. Specific changes to the legislation are proposed:
1) reducing the restriction of the inheritance rights of the testator, including the ability of children of 14-18 years old to independently draw up a will, for children under 14 years old - by legal representatives and guardians, but under the control of the guardianship authorities, using foreign experience for this;
2) limiting the possibility of restoring inheritance rights to an exhaustive list of cases: with the consent of the parties concerned, with the loss of a child, a person with limited or no legal capacity in the form of his legal representatives, or due to diseases that really prevent the acceptance of inheritance (coma, mental and physical disorders, etc. etc.) in order to reduce the possibility of judicial discretion, which may not always be correct;
3) addition of Chapter 65 of the Civil Code of the Russian Federation with the norms of inheritance of intellectual rights, applying general grounds to them, but taking into account the provisions of Part IV of the Civil Code of the Russian Federation;
4) addition of Chapter 65 of the Civil Code of the Russian Federation and Article 1112 of the Civil Code of the Russian Federation with the possibility of inheriting a number of personal non-property rights and other intangible benefits, according to the general rules established for accepting inheritance, taking into account the provisions of Chapter 8 of the Civil Code of the Russian Federation.

In the future, I am considering writing a large paper devoted to these problems [10].
